Terms of Service

The agreement between Cactus Corp. and the team that uses Cactus: what each side can expect, and what happens when something goes wrong.

Who these terms are between

Cactus Corp. ("Cactus", "we") makes Cactus. "You" is the company that uses it, and the person who accepts these terms for that company. If you accept them for a company, you are telling us you are allowed to.

They cover everything Cactus runs: heycactus.ai, the app at app.heycactus.ai, every Help Center, Cactus Messenger, the addresses AI clients connect to, and Cactus in Slack and Discord.

Using Cactus means you agree to these terms, to the Acceptable Use Policy and, where Cactus handles personal data for you, to the Data Processing Addendum. What we collect and why is on the privacy page.

Your account and your team

  • You sign in with Google or GitHub, and Cactus keeps no password. Keep that account safe: whoever can sign in to it can sign in to Cactus as you.

  • Whoever makes a team is its first Owner. Owners invite and remove people, change roles and delete products. Everyone on the team can read its pages, its conversations and the map of its code, and can connect sources.

  • A team made with a work email address is open to that address's domain: anyone who signs in with an address there joins it. An Owner can change that on the Team page.

  • You are responsible for what happens in your team: who joins it, what they connect and what they publish.

  • Cactus is for work. You need to be old enough to make a contract where you live.

  • If you think someone has got into your account, tell us at hello@heycactus.ai straight away.

What you connect

Cactus reads the sources you connect: code repositories through its GitHub App, a help site, Intercom conversations, the Slack channels you pick, and Discord messages addressed to Cactus.

Connect only what you have the right to share with us. If a source belongs to someone else, such as a client's repository or a Slack workspace you share with another company, get their permission first.

The GitHub App can read your code and cannot change it. What it reads, and where the code goes, is on the Trust Center. Disconnect a source in Settings and Cactus stops reading it.

Your content

Your code, your other sources and your customers' messages stay yours. So do the pages and answers Cactus writes for you.

You let us copy, store and process them only to run Cactus for you: to read your sources, write your pages and answers, show them to the people you choose, and keep Cactus working and secure.

We do not train models on your content, we do not sell it, and we do not hand it to anyone for advertising.

Some companies run parts of Cactus for us and receive parts of your content to do it. The privacy page and the Data Processing Addendum list them and what each receives.

What Cactus writes

Cactus writes from your sources and links each answer to what it read, so you can check it. It is still a model reading text, and it can be wrong or out of date. Check anything that matters before you act on it.

You choose what is published. Each page is set to Only you, Your team or Everyone. Your Help Center, its address for AI clients and the Messenger show a visitor only the pages set to Everyone that Cactus has also written for readers outside your team.

On your Help Center and in the Messenger, Cactus answers your customers for you. What it tells them is said on your behalf, as the rest of your own website is.

Your customers

When you publish a Help Center or put the Messenger on your site, the people who read it and write to it send their questions to Cactus. Tell them so in your own privacy notice, as you would for any tool on your site.

For their personal data you decide what Cactus does, and Cactus acts for you. The Data Processing Addendum says how.

Using Cactus fairly

Follow the Acceptable Use Policy. It lists what nobody may do with Cactus, such as publishing unlawful content, attacking Cactus, or trying to read another team's data.

Plans, trial and payment

The pricing page shows the plans and prices Cactus opens with. When they start:

  • Every team starts on Pro, free for 14 days. The 14 days start when you connect GitHub, and the trial needs no card.

  • When the trial ends, you keep Pro or move to Lite: Pro is 100 USD a month and Lite is 30 USD a month. Until you pick, your help site stays up as it is, and Cactus stops writing pages and answering questions.

  • You can move between the plans whenever you want, and teammates cost nothing extra.

Nobody is charged today. How billing, taxes, cancelling and refunds work will be written here before anyone is.

Our service

We work to keep Cactus running and your data safe. How we protect it is on the Trust Center.

Cactus changes often. We may add, change or remove features, and when a change takes away something your team uses, we tell your Owners by email first.

We do not promise that Cactus is always available or free of mistakes, and there is no uptime commitment today.

Cactus relies on other services, such as GitHub, Slack and the companies on the privacy page. When one of them is down, or changes what it allows, parts of Cactus may stop working until it is back.

Ending

  • You can stop whenever you want. Disconnect your sources in Settings, delete your products, and write to hello@heycactus.ai to close your account.

  • We can suspend or close a team that breaks these terms or the Acceptable Use Policy, or that puts Cactus or other teams at risk. Where we can, we tell you first and give you time to put it right.

  • When a product or an account is deleted, what we hold goes as the privacy page says. Before you close your account, you can ask us for a copy of everything we hold about you.

  • What these terms say about ownership, confidentiality, liability and the law still applies after an account is closed.

Confidentiality

Each of us will see things the other has not made public: for us, your code and your conversations; for you, anything we tell you about Cactus that is not on our website. Each of us uses the other's only for this agreement, and shares it only with people who need it for that and keep it to themselves too.

That does not cover what is already public, what one of us already had, or what the law makes one of us disclose. If the law makes us disclose your content, we tell you first, unless the law does not allow us to.

What Cactus owns

Cactus, its software, its website, and its name and mark belong to Cactus Corp. These terms let you use Cactus; they do not give you any of it.

If you send us ideas or feedback, we may use them without owing you anything for it.

Liability

  • Cactus is provided as it is. As far as the law allows, we make no promise about it beyond what these terms say, including that it suits a particular purpose.

  • Neither of us is liable to the other for lost profits, lost revenue, or indirect or consequential loss.

  • Each side's total liability under these terms is no more than what you paid Cactus in the 12 months before the claim.

  • These limits do not apply where the law does not allow them to.

Changes to these terms

When these terms change, we update this page and its date. When a change matters to how you use Cactus, we email your team's Owners before it takes effect. Using Cactus after that means you accept the new terms.

Law and disputes

Which law governs these terms, and where a dispute between us is heard, is being settled with our lawyer, and will be written here before anyone is charged. Until then, if something goes wrong, write to hello@heycactus.ai first, and we will try to settle it with you directly.

Everything else

  • These terms, the Acceptable Use Policy and the Data Processing Addendum are the whole agreement between us about Cactus.

  • If one part of them cannot be enforced, the rest still applies. If one of us does not enforce a part straight away, it can still do so later.

  • Either of us may pass these terms on to a company that takes over its business. Otherwise, neither of us may pass them on without the other's agreement.

  • Neither of us is liable for a delay or a failure caused by something outside its reasonable control, such as a natural disaster, a war, a power cut, or an outage at a provider it relies on.

  • We send notices to the email address on your account, and you send yours to hello@heycactus.ai. An email counts as notice in writing.

  • These terms are written in English, and the English is what counts.
